Shortly after the turn of the new millennium, the Darfur mass murders accompanied by unimaginable destruction, mass rapes, and dislocation followed a familiar trend that has long demanded a concerted, prompt effort as the rest of the world watched the events of the other side of human nature unfold unabated. Sixty years after the United Nationsââ¬â¢ Convention on the Prevention and Punishment of the Crime of Genocide (CPPCG), and two solid decades after its ratification by the most powerful nation on earth, the United States, the world still lacks reliable institutional frameworks to confront the evil inherent in the subject matter at hand. The term ââ¬Ëgenocidesââ¬â¢ has its origin in the work of Raphael Lemkinââ¬â¢s 1944 analysis of the Holocaust titled Axis Rule in Occupied Europ e; an enormous task that basically found the phrase ââ¬Ëmass killingââ¬â¢ rather inadequate to fully capture the atrocities of the event (Kentis, 2011, p.3). Before Lemkinââ¬â¢s work, crimes of mass atrocities [ââ¬Å"crimes of crimesâ⬠] lacked ââ¬Å"explicit identityâ⬠(Power, 2002, p. 30). Scholars are in agreement that genocides are not natural disasters, but man-made occurrences that are preventable. (Fein, 2000, p. 42). Despite the inherent flaws with regards to the legal definition adopted at the above mentioned convention concerning what exactly constitutes genocide, its recognition as a crime of humanity, without a doubt, reinforced the legitimacy by the international community to act, on humanitarian grounds, to prevent and possibly stop the elements with ill intentions from actualizing any form of pre-planned atrocities. To date, the conventionââ¬â¢s statutes largely remains monumental with genocide intervention, even with immense evidence of ethnic cleansing taking place, occurring at the final stages of Stantonââ¬â¢s eight stage model (Stanton, 2008). This paper briefly elaborates on some of the barriers towards effective prevention of world genocides and crimes against humanity; and where possible the analysis will include the flawed nature of the theo retical frameworks that seem to work only in paper, the blockade erected by the concept of ââ¬ËState sovereigntyââ¬â¢, the difficulty of holding perpetrators to account, and the general lack of international will/interest to intervene in matters considered domestic. The Impediments to the Prevention of Crimes against Humanity The campaigns initiated by Lemkin to include and subsequently prohibit genocide under the international laws was more than a welcome call for international action as demonstrated by UN General Assemblyââ¬â¢s nod on the 9th December 1948. The society-at-large is always demanding high ethical and moral standards from organizations. Unethical behavior is always seen as a virus working on the society and eating it up. In a business organization, the top level managers have a big part to play when it comes to ethical issues. How they react when it comes to ethical dilemmas makes a big difference as to how the other employees of that organization will face the same situation. A big example is what Johnson Johnson Company executives did when the Tylenol poisoning took place. They pulled out all the stocks out of the market even thou it cost them millions of dollars, because the management knew it was the ethical thing to do. It uplifted their image amongst its customer base rather than downgrading it since the customers could see that the company had their best interests at heart. That particular reaction set a big example for other org anizations throughout the world to follow. When it comes to ethical behavior in the long run, I believe it will pay off for any organization. In todays intense business environment its more important than ever to have strong ethical programs in place. In a survey conducted by the ethics resource centre on more than 4,000 employees, one third had witnessed ethical misconduct in the past year (Flynn, 1995). Ethical standards depict behaviors morally accepted as good and right as opposed to bad or wrong in a particular setting it is particularly crucial for the business for a number of reasons. For example, murder and robbery are not only illegal but are universally regarded as wrong, while dishonesty , while not necessarily illegal, is usually thought to be immoral. They are created and adopted by people who are interested primarily in ensuring there are guidelines for behavior for the group members. For example, doctors and lawyers have ethical codes of practice which they sear to uphold as part of their professional practice. Ethics in the society carries a lot of value, so I believe that ethical behavior is what all working professionals should aim to have. However its not just the ethical attributes that the employees and organizations should have, but also the behavior they put forward with regards to those ethical issues is also important. To build a good career one should live there life by rules of ethics in order to safeguard themselves and also society as a whole. Most business experts suggest that establishing a code of conduct can help the company to behave ethically. A code of conduct is a formal document stating the principles and the ethical rules it expects the employees to follow in the organization. Ethical standards protect the business from scandals and prevent them in the future. Ethical statements imply the employees, business associates, and the larger community a framework of the companys operating principles (rules and regulations) which needs to be followed, why the company exists, what the company believes in, and how it goes about to comply with its professed beliefs. In addition, reviewing the standard operating procedures and performance measurements will ensure the business owners and managers that it is well structured and does not encourage unethical behavior. An Asian Nuclear Cooperation Regime I. Introduction Nuclear cooperation regimes have long been considered as confidence-building measures designed to reduce tensions arising from the uncertainty of nationsââ¬â¢ nuclear energy programs. The first such regime was EURATOM, which emerged in Europe as a separate system of safeguards and transparency measures for European states. This regime was consistent with the goal of the political unification of the European Economic Community, and might not have functioned as effectively had it not been tied to that political effort. Currently a discussion of an Asian nuclear cooperation regime is underway, initiated by Japanese officials and intellectuals, which may borrow substantially from the European experience in nuclear cooperation. These officials have proposed the creation of an ASIATOM, which would include Japan, China, North Korea, South Korea, and possibly Taiwan. Others have expanded the regimeââ¬â¢s potential membership to the U.S., Canada, and Australia, and labeled the potential group PACATOM. There have been several proposals for such a nuclear cooperation regime, and they vary according to the activities encompassed and the degree of cooperation involved. The central point of controversy over ASIATOM proposals has been the issue of reprocessing. Japan has currently invested substantial amounts of its resources into the development of civil reprocessing capability, and China may be prepared to do the same. The United States would be unlikely to violate its Carter Administration policy of discouraging reprocessing outside the U.S., and would be unlikely to support or join an ASIATOM that involved reprocessing. One anonymous U.S. State Department official stated, "ââ¬â¢Clearly, if an Asiatom proposal is about reprocessing, itââ¬â¢s not going to flyâ⬠¦And if it excludes the U.S., itââ¬â¢s not going to fly,ââ¬â¢ the official said, adding: ââ¬ËJapan does not want to go it alone.ââ¬â¢"1 The reprocessing issue is also the central reason for the general support for the idea of an ASIATOM in Japan. Japanââ¬â¢s civilian reprocessing proposals, with plans to move to fast-breeder reactors, has made some states in the Asia- Pacific region wary of their intentions. After all, reprocessing of spent fuel involves the separation of plutonium, and even reactor-grade plutonium (involving greater concentrations of Pu-240 and Pu-242) is suitable for weapons production in sufficient quantities. Japanââ¬â¢s reprocessing program has caused other states in the region to begin to raise the issue of developing their own reprocessing capabilities. From the U.S. perspective, the spread of reprocessing capability is damaging to regional security interests because of the possibility of the use of reprocessing for either deliberate national-level nuclear weapons production or the possibility of the theft of separated fissile material.
